Pick ups and drop offs - on all trips outbound pick ups are stated in order on Taquilla Tickets itinerary, on the return journey the drop offs are done in reverse order... so last pick up, is first drop off. · 2.7. Should you get on the incorrect bus having paid for our services and trip, we are not responsible and at no point would you be entitled to a refund for our trip you missed. · 2.8. The event organiser has the right to add or vary the advertised program, seating arrangements and audience capacity and deny admission with reasonable cause including due to intoxication, unsociable behaviour, failing to observe lawful directions, possession of invalid or insufficient tickets or ID or health and safety precautions. · 2.9. You are responsible for having your tickets, as purchased through Taquilla Tickets available at the event. No refunds or exchanges are provided for lost or stolen tickets or for a failure on your part to present at the event. It is your responsibility to provide correct e-ticket information (email address / mobile number) to allow adequate time for the delivery of tickets. · 3.0. The lead person booking for a group of people is responsible for informing Taquilla Tickets if the lead person cancels but others in the group are still on the booking and therefore supplying Taquilla Tickets with an up to date contact number so that Taquilla Tickets can send the itinerary to those still booked on the trip. If failure to communicate updated information to Taquilla Tickets results in others not receiving itineraries and subsequently missing the pick up time, Taquilla Tickets cannot be held responsible and no refund will be given. · 3.1. Taquilla Tickets offer a Loyalty Card scheme - this is only open to people aged 18 & over and no child places are included in the scheme. The card has NO monetary value and cannot be exchanged for cash. If the Loyalty Card has a valid from / valid to date, it cannot be redeemed after the expiry date on the card. In some cases, if the card is not complete, Taquilla Tickets may offer to transfer the stamps on the expired card to a new card (if requested within 2 weeks from when the card expired) and this will be valid for 3 months. · 3.2. Taquilla Tickets have the right to: refuse access or remove people from our coaches on outbound or return journeys, refuse a booking from people or cancel their booking entirely for the following reasons... Drunk / disorderly / offensive / verbally abusive / violent..... against any member of our staff or customer / consuming alcohol / cannot produce proof of booking, ie official ticket or name on Taquilla Tickets checklist for the trip in question. · 3.3. Taquilla Tickets can in no way be held responsible for a venue´s refusal for your activity, such as age, weight or height restrictions for activities, rides / water slides etc. Such restriction information is given on Taquilla Tickets website and information sheets where applicable. The venue will have restrictions listed on its own website which can be accessed by customers prior to booking with Taquilla Tickets. · 3.4. Taquilla Tickets offer a Trips & Giggles Membership Club - this card cannot be used with any other offer to get further discount on tickets TICKETED EVENTS such as concerts, theatre performances, water / theme park entrance tickets etc.... all payments / deposits for such events are non refundable where tickets have been purchased for the individual for the event / trip. No refund will be given for the cost of tickets that Taquilla Tickets has purchased for the event, at any time of cancellation prior to the event, even if cancelled more than the 5 days deadline. Child Tickets: . Taquilla Tickets have the right to ask the age of any child when purchasing tickets for an event / venue where specified age requirements are requested. Any child ticket purchased via Taquilla Tickets when the child´s age is not in the required age bracket, Taquilla Tickets are not held responsible for any additional payment requested by any event organisers or venues at the entrance if they deem the child to be over the specified age requirements or for the child being refused entry if younger than specified age requirement.... Both Condado and Camposol offices accept payment by cash or card - in card transactions a card fee may be added to cover the cost of the charge incurred by Taquilla Tickets for the use of the card service. For clarification, you are not entitled to a refund if: You miss the date / You miss the Transfer * / You book the wrong flights / You get on the wrong bus / You do not wear suitable footwear as instructed in TT itinerary and find walking uncomfortable / You decide less than 5 days before the arranged date for any Day Trip, 2 weeks before any Mini break or 5 weeks before any Cruise** , that you do not want to go, or cant participate for personal reasons or illness / the times do not suit your personal circumstances on that particular day / you decide the weather may not be suitable even if the trip or event has not been cancelled by either TT or the event organisers / you guess the time of the pick up and it is not what is in the itinerary and miss the pick up. - In some cases Taquilla Tickets, at their discretion, may offer (1)- a partial refund less administration fee of €7.50 p/p, (if individual ticket price is more than €20) or €5 p/p (if individual ticket price is less than €20) against the cost of any event tickets / hotel rooms already purchased or (2)- offer to transfer the cost against another trip - (not applicable for Cruise) this cost will be transferrable only once, after this the refund is null & void. Any credit given is only valid for 1 year for non-residents and 6 months for residents. (3) - If your ticket can be resold, in these circumstances, Taquilla Tickets can give a refund minus our €7.50 per person administration fee. · 5.2. If your booking is an experience trip (such as boat trip / wine tasting / guided tour etc) Taquilla Tickets may offer a refund if cancelled prior to the 5 day deadline minus €7.50 per person administration fee and this will be transferred within 10 workings days after the trip is completed. No refunds can be given prior to the trip as monies for the experience have to be refunded to Taquilla Tickets by the venue / guide / company. When monies to be refunded which have to come from a booking agent or 3rd party, this process may take up to 15 working days. · 5.3. If your booking includes a ticket for a concert, theatre production, water or theme park entrance ticket, and Taquilla Tickets have already purchased the ticket to secure it for the customer, Taquilla Tickets will not issue a refund for the ticket, even if cancelled more than the 5 days deadline. · 5.4. If a trip is cancelled or rescheduled by Taquilla Tickets for any reason, you are entitled to a full refund or the cost can be transferred and used against other trips, subject to proof of payment for the trip. Taquilla Tickets will return the money the way it was paid, so cash for cash, card for card and via website or other secure link, the refund will be returned to the card used to pay. All card refunds will be returned as soon as possible but this can take up to 10-15 working days during busy periods (any card charges on the initial transaction are not refunded, only the price of the ticket for the trip). If you paid in cash for your trip and require a refund in cash then your ticket must be handed over to Taquilla Tickets when requesting the refund. Trips can only be refunded within 1 year for non-residents and 6 months for residents, subject to agreement with Taquilla Tickets and valid proof of purchase given. If you choose to transfer the monies to another trip, the credit is valid for 1 year for non-residents and 6 months for residents. If you paid by card (including card charge where applicable) and want your refund in cash, the refund will be given as the amount of the ticket only, the card charge will not be refunded as the charge is not a payment to Taquilla Tickets and has been charged to Taquilla Tickets for the original transaction for which Taquilla Tickets are not refunded . · 5.5. The lead person booking for a group of people is responsible for informing Taquilla Tickets if the lead person cancels but others in the group are still on the booking and therefore supplying Taquilla Tickets with an up to date contact number so that Taquilla Tickets can send the itinerary to those still booked on the trip. If f ailure to communicate updated information to Taquilla Tickets results in others not receiving itineraries and subsequently missing the pick up time, Taquilla Tickets cannot be held responsible and no refund will be given. · 5.6. If your ticket to an official event is lost, stolen or damaged (including if it is lost in the mail), we are not required to replace it unless we can identify the seat corresponding to the ticket, or in the case of a general admission ticket can identify and cancel the relevant ticket. We charge a €7.50 per person administration fee in these circumstances. · 5.7 The confirmation of weather conditions determined by the local or regional authorities will be adhered to by Taquilla Tickets and as such Taquilla Tickets will only refund if the event is cancelled by the authorities or Taquilla Tickets. · 5.8 When a trip is cancelled and a refund offered / required, Taquilla Tickets will return the money the way it was paid, so cash for cash, card for card and via website or other secure link, the refund will be returned to the card used to pay. All card refunds will be returned as soon as possible but this can take up to 10-15 working days during busy periods. · 5.8.1 - When an event / concert is cancelled and not rescheduled for a new date, Taquilla Tickets will offer refunds subject to conditions of the event / concert / agent booking. When monies to be refunded which have to come from a booking agent or 3rd party, this process may take up to 15 working days or longer depending on when the agent refunds the booking money to Taquilla Tickets. No monies will be refunded to customers until Taquilla Tickets has received refund from the venue / booking agent. Taquilla Tickets are in no way responsible for delayed refunds by the event organiser and all customers will receive a full refund in due course. · 5.9 . For a venue´s refusal for your activity, such as age, weight or height restrictions for activities, rides / water slides etc. Such restriction information is given on Taquilla Tickets website and information sheets where applicable. The venue will have restrictions listed on its own website which can be accessed by customers prior to booking with Taquilla Tickets · 5.9-1 . Taquilla Tickets are not responsible for any purchase made at any event / shop / venue on any trip where the receipt has not been checked by the customer prior to leaving the establishment and later noticed of an overcharge by the event / shop / venue. No reimbursement will be given by Taquilla Tickets. · 6.0. Taquilla Tickets have the right to refuse a booking from people or cancel their booking entirely for the following reasons...if that person has been d runk / disorderly / offensive / verbally abusive / violent..... against any member of our staff or another Taquilla Tickets customer. · 6.1 Taquilla Tickets have the right to not refund any trip without customer proof of payment made... such as email confirmation, WhatsApp message, physical ticket for the trip or written notification. Trips can only be refunded within 1 year for non-residents and 6 months for residents, subject to agreement with Taquilla Tickets and valid proof of purchase given. TICKETED EVENTS such as concerts, theatre performances, water / theme park entrance tickets etc.... all payments / deposits for such events are non refundable where tickets have been purchased for the individual for the event / trip. No refund will be given for the cost of tickets that Taquilla Tickets has purchased for the event, at any time of cancellation prior to the event, even if cancelled more than the 5 days deadline. In some instances, if Taquilla Tickets can resell the tickets, a refund may be given less the booking fee of €7.50 per ticket REFUND PAYMENTS & TIMESCALES Taquilla Tickets timescales for refunds are AFTER the date scheduled for the trip in question, not from when the date the trip was cancelled, and endeavour to refund as soon as possible after the date of the trip. Taquilla Tickets will return the money the way it was paid, so cash for cash, card for card and via website or other secure link, the refund will be returned to the card used to pay. All card refunds will be returned as soon as possible after the date of the trip (any card charges on the initial transaction are not refunded, only the price of the ticket for the trip) but this can take up to 10-15 working days during busy periods (summer, Easter, Christmas etc) . If you paid in cash for your trip and require a refund in cash then your ticket must be handed over to Taquilla Tickets when requesting the refund. If you paid by card (including card charge where applicable) and want your refund in cash, the refund will be given as the amount of the ticket only, the card charge will not be refunded as the charge is not a payment to Taquilla Tickets and has been charged to Taquilla Tickets for the original transaction for which Taquilla Tickets are not refunded. Trips can only be refunded within 1 year for non-residents and 6 months for residents, subject to agreement with Taquilla Tickets and valid proof of purchase given. Where an event is cancelled by the event organiser, and not Taquilla Tickets, the event organiser is solely responsible and liable for providing any refund or comparable ticket where an event is cancelled, varied or postponed. Taquilla Tickets will refund you for any event cancelled by the organiser once Taquilla Tickets has received the full refund of monies paid for the event tickets and this can take from weeks to months depending on the event organiser which is out of Taquilla Tickets hands. Taquilla Tickets are in no way responsible for delayed refunds by the event organiser. * If you are late and miss the coach back from a trip where Taquilla Tickets have specified the return time and you have to make alternative transport arrangements, Taquilla Tickets are in no way liable to reimburse your payment for the transport. ** Cruise - depending on how long prior to a cruise departing you cancel your booking, a partial refund of your deposit / full payment may be possible depending on the Terms & Conditions of the Cruise Line / Agent. Taquilla Tickets will request and inform of any refund if it is available. Taquilla Tickets are not held responsible should the Cruise Line / Agent refuse to refund any deposit in line with their Terms & Conditions. Taquilla Tickets are in no way liable to pay any refund from their own monies if the Cruise Company do not offer a partial or full refund. For all Cruises, please read the full Terms & Conditions of the Cruise Company regarding payments and if their policy is to refund at any time for any cancellation. Taquilla Tickets are bound by the rules of the Cruise Company. 6. Gift Vouchers · 6.1. Taquilla Tickets offer Gift Vouchers which can be purchased at either office with cash or card payment · 6.2. Vouchers must be paid for in full when booking and can be any amount which will be displayed on the voucher. · 6.3. TT will create the voucher to show the amount valid in € as well as the name of the recipient. This can be supplied as either a physical voucher or PDF format. · 6.4. To claim the voucher against any trip in full or part payment, the holder must come either TT office to book and hand over the voucher and submit ID to match the name on the voucher for it to be valid and redeemed. · 6.5. The holder will be given a valid ticket for the trip(s ) redeemed against the voucher. · 6.6. The voucher cannot be exchanged for cash equivalent. · 6.7. The holder of the voucher is not entitled to a duplicate voucher should the original be lost or damaged. · 6.8. The holder of the voucher is not entitled to a cash refund should a trip be cancelled or they cancel outside the timeframes stated in T&C 5.1 - credit for an alternative trip will be offered but this can only be transferred once and thereafter the voucher is void. · 6.9. Every voucher will have a Date of Issue and is valid for a timeframe of: (1) 6 months from Date of Issue for Spanish Residents (2) 1 year from Date of Issue for non Spanish Residents 7. Unauthorised Use The following are examples of unauthorised use of the Site and therefore such actions constitute a breach of these Terms. You agree that you will not: · 7.1. facilitate illegal ticket sales or use the Site to resell tickets of any kind, including by way of unauthorised framing or links to other sites for the purpose of reselling; · 7.2. interfere with the proper working of the Site or take any action that imposes an unreasonably large burden on the Site; · 7.3. request more than 1,000 pages of the Site in any twenty-four hour period or make any other request to transactional servers more than once during any three second interval (this applies equally to a group of individuals acting in concert); or · 7.4. hack into the Site or utilise automated means to process or place ticket orders including the use of robots, spiders or other devices to process ticket sales. 8. Permitted Use of the Site · 8.1. You may use the Site for your personal use only. You may make a temporary copy of all or part of the Site on your local computer for the sole purpose of viewing it. You may also retain a single permanent copy of a part of the Site for your personal use (including to purchase tickets). You may not otherwise in any form copy, reproduce, modify, create derivative works, publish or distribute the material on the Site without the prior written consent of Taquilla Tickets or as permitted by applicable copyright laws. · 8.2 All content, images, software and designs on the Site (“Content”) are owned by us or used under licence or with consent, including from event organisers. The Content is protected by copyright under the laws of the Eu and other countries through international treaties. You must not remove any proprietary notice or credits contained on the Site. · 8.3. The Site contains trade marks, logos and trade names of Taquilla Tickets which may be registered or otherwise protected by law. You must not use any trade marks, logos or trade names which are used on the Site. Nothing contained on this Site should be construed as granting any licence or right to use any trade mark displayed on the Site. · 8.4. We reserve all of our rights to enforce our intellectual property rights to the fullest extent of the law. 9. Breaches of Terms If you breach these Terms or we believe you are, or were acting in concert with any person who has done so, we may without prior notice: · 9.1. block or limit your access to the Site; · 9.2. cancel any tickets, registrations or ticket orders you have placed via the Site or in person without refund; · 9.3. take legal action against you; and/or · 9.4. prohibit you from future ticket or registration purchases via the website or in person; 10. Disclaimer and Limitation of Liability · 10.1. You use the Site at your own risk. · 10.2. We do not guarantee, represent or warrant that the Site will be free of defects or bugs, or that your access will be uninterrupted, timely or error-free. Your access to the Site may be suspended without notice in the case of system failure, maintenance or repair or any reason beyond our control. · 10.3. We reserve the right to change or discontinue any feature or service on the Site at any time. · 10.4. To the extent permitted by law, we exclude all conditions and warranties relating to your use of the Site that are not set out in these Terms. · 10.5. The goods and services provided by Taquilla Tickets come with certain guarantees that cannot be excluded under the Spanish Law. Our liability for any breach of those guarantees is limited to the replacement of goods or re-supply or services or the replacement cost of goods or re-supply of services. As agent for the event organiser, our services to you are solely the facilitation of ticket sales. · 10.6. In relation to any express warranty or condition set out in these Terms in connection with goods or services supplied or offered by us via the Site, our liability to you will be limited to the amount(s) paid by you (if any) in respect of those goods or services. · 10.7. Taquilla Tickets disclaims any and all liability for the acts, omissions and conduct of any event organisers, booking agents, third party users, promoters, advertisers and/or sponsors who acted on our behalf. Taquilla Tickets are not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with any event, trip or cruise. 11. Indemnity You agree to fully indemnify and hold us harmless against any expenses, costs, loss (including consequential loss) or damage that we may suffer or incur as a result of or in connection with your use of, or access to or conduct in connection with the Site, including any breach by you of these Terms. 12. General Provisions · 12.1. The Terms shall in all respects be governed by the relevant laws. You consent to the exclusive jurisdiction of the courts in Murcia to determine any matter or dispute which arises under the User Terms. · 12.2. If any provision of the Terms is deemed invalid or unenforceable, all or part of that provision will be severed from the Terms and will not affect the enforceability of the remaining provisions of the Terms. 12.3. No waiver of any term of the Terms shall be deemed a further or continuing waiver of such term or any other term. Any failure to assert any right under the Terms shall not constitute a waiver of such right. LATE RETURNS TO THE COACH - all customers are responsible to ensure themselves / their party, are at the pick up point for the coach on time for the return journey. All customers are requested to be back at the coach by a specific time as per the itinerary to enable the coach to leave on time as per its schedule. If an event has police traffic control in place for coach pick ups and Taquilla Tickets receives a fine from the police for exceeding the pick up time allocated due to late customers (without good reason), Taquilla Tickets has the right to request payments from those who delayed the coach to cover the cost of the fine. Any customers who do not arrive to meet the coach at the time specified, and cause delayed departure on a return trip, and cannot get back to meet the coach at our allotted time, then they will have to make their own way home at their expense. Taquilla Tickets are in no way liable to reimburse your payment for the transport. Line Buses (water park & port) If you are late and miss the coach back from the water park or the port where Taquilla Tickets have specified the return time and you have to make alternative transport arrangements, Taquilla Tickets are in no way liable to reimburse your payment for the transport. TRIPS & GIGGLES Members Terms & Conditions: Discounts are given for day / evening trips or mini breaks but not on our line buses in the summer / Easter, any event or trip with ticket entrance, or any concerts or cruise. · Only 1 Membership per person per year. · Members can only use their card for their discount for trips. · Members cannot use their card to get discounts for other people. If any member is found to have used their card to pay for a non member to receive the discount, their membership will be revoked and fee forfeited. · Membership discount cannot be used in conjunction with any other offer such as TT Loyalty Card, Gift Vouchers or existing credit. Booking trips in our offices: · When booking in person at either of our offices, Membership Card must be shown to receive the Members discount. · Any non-Members booking for Member(s) as part of a couple / group, the non Member must give the name(s) and Membership number(s) of the Member(s) so this can be verified by Taquilla Tickets before any discount is given. Booking trips on the website: · Members must book the Members price and in the Members Section on the booking form, put in their Membership Number. · If a Member is booking for more than one person but others are not Members, then use both the Members Price and then the standard price for the others in the party. If all are booked under the Members price, the booking will be cancelled, money refunded and then will need to be rebooked correctly. · If Members book for more than one Member, then all Membership Numbers must be put into the Members Section on the booking form so this can be verified by Taquilla Tickets and the booking approved. · Any non-Members booking for Member(s) as part of a couple / group, the non Member must give the name(s) and Membership number(s) of the Member(s) in the group in the Members section on the booking form so this can be verified by Taquilla Tickets and the booking approved.
